The Terms and Conditions of Use (“Agreement”) are provided by the Eilers Law Group, which is a Florida law practice, practicing out of office and via MyCase, with offices in Miami, Florida. The Eilers Law Group is managed by William Robinson Eilers, an attorney barred in the state of Florida. This Agreement shall govern your use of our website, including all content provided on the website and through access to all online services provided by the Eilers Law Group By continuing any communication or exploration of this site, you hereby agree to the terms and conditions as set forth herein for the entirety of your use and enjoyment thereafter. If you so choose to engage the Eilers Law Group for legal or other professional services, there shall commence a separate agreement to provide services to commence upon our acceptance to provide services, unless otherwise stipulated in a separate agreement. By engaging our virtual law office, you understand and agree that given geographical or other constraints, it may be your responsibility to proceed as a pro se litigant by filing all legal documents and complying with Federal, Florida and local laws and regulations. Such transfer of responsibility shall be be explicitly expressed to you by an authorized agent of the Eilers Law Group Moreover, when providing you limited services through our cloud based services, you understand and agree that the Eilers Law Group may attend hearings or trials on your behalf or provide any other legal services that may be limited by geographical or otherwise limiting factors.

Limitation of Services

While authorities in some jurisdictions may deem this website and this law practice to be an advertisement for legal services in their jurisdiction, our website is not to be considered as a solicitation for legal services related to any other states’ law. This website and this legal practice offer services related to Federal and Florida law only. Unlike a geographically located law practice, the virtual law offices of the Eilers Law Group will not provide physical legal representation or commence litigation on your behalf. The purpose of the virtual law offices of the Eilers Law Group is to provide limited legal advice and general counseling on Federal and Florida law matters utilizing the benefits of our modern infrastructure. As with any legal service, we cannot guarantee any legal outcome. Client agrees that Attorney makes no guaranty regarding the outcome or success with regards to Client’s matter. Attorney does not have or hold any power to guarantee any certain outcome in favor of Client.

Confidentiality

the Eilers Law Group provides limited legal services pertaining to Federal and Florida law only. The attorney responsible for this site is licensed to practice law only in the State of Florida. In compliance with the professional rules and restrictions of the Supreme Court of the state of Florida and the Florida Bar Association and for reasons of personal integrity, this practice is bound by stringent professional standards of confidentiality. Any information received by us from our clients is held in strict confidence and is not released to anyone outside of this practice, unless agreed with by you, or as required under applicable law. When using our virtual law offices only, an attorney-client relationship with this practice is established only after a specific question has been posed to an attorney at this practice through a prospective client’s personal login page and that question has been confirmed as received through a reply communication from an attorney at this practice. Prospective clients should be aware that our duties of confidentiality and the attorney-client privilege may not arise until an attorney has expressly communicated the ability to respond to that prospective client. Jurisdiction

The terms of this and any Agreement between you and the Eilers Law Group shall be governed by the laws of the State of Florida unless otherwise explicitly stated and agreed upon in writing. The forum shall be Miami-Dade County Florida.

Mediation and Arbitration

In the event a dispute arises out of or in connection with this Agreement, the Parties will attempt to resolve the dispute through friendly consultation.

Mediation.

If the dispute is not resolved within a reasonable period then any and all outstanding issues may be submitted to mediation with a mediator certified by the appropriate court or government body and in accordance with the appropriate state regulations for certified or court appointed mediators.

Arbitration.

If mediation is not successful in resolving the entire dispute or is unavailable, any outstanding issues will be submitted to final and binding arbitration in accordance with the laws of the State of Florida. The Parties agree to submit to the rules of either the American Arbitration Association or the National Arbitration Forum at the election of the complaining Party. The Parties agree that the forum shall be Miami-Dade County, Florida and that this Agreement and all matters herein shall be controlled by the laws of the State of Florida and the Rules of the chosen body to govern the arbitration. The arbitrator’s award will be final, and judgment may be entered upon it by any court having jurisdiction within the State of Florida.

Assignment

The rights and obligations created for you under this Agreement may not be assigned to any other party.

Force Majeure

the Eilers Law Group will not be deemed to be in breach of this Agreement for any delay or failure in performance caused by reasons out of its reasonable control, including acts of God or a public enemy; natural calamities; failure of a third party to perform; changes in the laws or regulations; actions of any civil, military or regulatory authority; power outage or other disruptions of communication methods or any other cause which would be out of the reasonable control of the Eilers Law Group

Severance

In the event that one or more of the provisions of this Agreement shall be found unenforceable, illegal or invalid, it shall not affect any other provisions of this agreement, and this agreement shall be construed as if the provision found to be unenforceable, illegal or invalid had never been contained in the agreement, or the unenforceable, illegal or invalid provision shall be construed, amended and/or reformed to be made enforceable, legal and valid.

IRS Circular 230 Disclosure

In compliance with the requirements of the IRS pertaining to the publication of Circular 230, we inform you that any advice contained on this website or in any communication originating from this website or this law practice which is related to U.S. federal tax advice is not intended or created to be used, and cannot be used, for the purpose of 1) either avoiding penalties under the Internal Revenue Code or promoting, marketing or 2) recommending to another party any transaction or matter that is contained on this website or in any communication originating from this law practice.

Entire Agreement

This Agreement supersedes any prior or contemporaneous communications, representations or agreements between the Eilers Law Group and the client and constitutes the complete and final agreement between the parties relating to this agreement, the Eilers Law Group website or any services provided by the Eilers Law Group
